Assumption of Risk, Release & Indemnification

1. Assumption of Risk​

Camping and outdoor recreational activities involve inherent risks, including but not limited to:

 

  • Uneven terrain, falling branches, and weather conditions

  • Wildlife encounters and insect bites

  • Campfires and use of tools or equipment 

  • Physical exertion and the actions or omissions of other participants 

By participating in the BACK TO THE STICKS event, you voluntarily assume all risks of injury, illness, property damage, or death arising from your participation. 

2. Release of Liability 

To the fullest extent permitted by Delaware law, you release and discharge the Property owner, event organizers, their agents, representatives, employees, volunteers, successors, and assigns (the "Released Parties") from any and all claims, demands, causes of action, damages, losses, costs, or expenses arising from your presence on the Property or participation in the BACK TO THE STICKS Event. 

This release does not apply to claims arising from the gross negligence, reckless conduct, or intentional misconduct of a Released Party.

3. Indemnification & Hold Harmless 

You agree to defend, indemnify, and hold harmless the Released Parties from any claims, liabilities, damages, judgments, losses, costs, and expenses (including reasonable attorney's fees) arising from:

  • Your acts or omissions while on the Property or at the Event 

  • Your violation of any law, regulation, or Event rule

  • Injury, death, or property damage caused by you to any person or property 

  • Third-party claims arising fro your conduct or participation

This indemnification obligation survives the conclusion of the Event. 

4.  Compliance with Rules 

You agree to comply with all BACK TO THE STICKS event rules, safety requirements, fire restrictions, and instructions provided by the event organizers or Property owner at all times during the BACK TO THE STICKS event. 

5. Governing Law 

This Agreement is governed by the laws of the State of Delaware, without regard to its conflict-of-law principles. 

6. Severability 

If any provision of this Agreement is found unenforceable, the remaining provisions shall remain in full force and effect.
